1. Who we are
Presave (presave.club) is run by [to confirm: legal name of the company, registered address and company number]. You can reach us at presaveclub@gmail.com.
2. What Presave does
Artists share an unreleased track through a link. Each fan can listen to it once before release day and pre-save it. Artists see who pre-saved; creators can share links to paid tracks and earn a share of the listens they bring.
3. Your account
You log in with a code we email you; there is no password. You must be at least [to confirm: 16] years old to have an account, and 18 to earn money as a creator. Keep access to your email to yourself: anyone who can read it can log in as you.
4. For artists
- You may only upload music whose rights you control. When you upload you declare that you own or control the recording and the song (music and lyrics), or that everyone who does (co-writers, producers, featured artists, your label or publisher) has agreed; that no deal stops you sharing the track before its release date; that it has no samples or beats used without permission; and, if you are a member of a collecting society such as IMRO, PRS or ECAD, that you checked it lets you share the track here. We keep a record of that declaration.
- By uploading, you give Presave a non-exclusive, worldwide, royalty-free licence to store the track, make the watermarked version and play it to fans on your links until its release date, for as long as it stays on Presave. You keep all your rights. The licence ends when you delete the track or your account.
- If we receive a credible claim that you don’t control a track, we take it down, freeze your account until the case is resolved, and may pass your details to the person claiming. You are responsible for any cost that a false declaration causes us.
- Every link carries spoken watermarks: 16 on Free, 8 on Share and 4 on Career. They are required, so that a leaked copy points back to where it came from.
- Release dates: Free from day 16 to day 180 after upload, Share from day 31, Career from day 91. The date can’t change once set.
- We keep only the watermarked version. Your original file is deleted once that version is made. A track dropped on the home page and not confirmed by email within 7 days is deleted.
- Plans are paid once per track, VAT included. To change plan, upload the track again.
5. For fans
- You get one listen per track. If your connection drops you can carry on within 15 minutes; after that the listen is used.
- When you pre-save, the artist sees your name and city. They see your email only if you tick the box to share it.
- On release day we email you that the track is out, with the artist’s links.
- If a listen fails because of a fault on our side, it doesn’t count and, on Career, you are not charged [to confirm: this is decided but not yet built].
6. For creators
- Creator links exist only for Career tracks, where fans pay €1 to listen.
- You earn 30% of each paid listen that comes through your link; the artist keeps 60% and Presave 10%. You can ask for your balance at any time, any amount, from your dashboard; until payments are automatic, we arrange each transfer with you by email.
- Follow the artist’s guidance, don’t post the full track, and don’t send spam. We can remove links and withhold earnings from abuse.
7. What you must not do
Record, copy or redistribute tracks; try to get around the one-listen rule; create accounts to listen or earn more than once; upload music that isn’t yours; or interfere with the site. We may suspend accounts that do.
8. Reporting music that isn’t theirs
If a track on Presave uses your music without permission, email presaveclub@gmail.com with the link to the track, what you own in it, and how we can reach you. We take the track down while we look into it and reply as soon as we can.
9. Liability
We provide the service with care but can’t promise it will always be available. [to confirm: limitation of liability wording and governing law, e.g. Ireland.]
